1. HOW TO ENTER.                                                                                          

(a)  Dr. José Antonio Castañeda and Humanicare Inc. are sponsoring a promotion in which the winner will receive one Weight Loss Surgery provided and performed by Dr. José Castañeda and a 12-month comprehensive post-operative support and coaching program administered by Humanicare Inc. (“Slim Down To Stardom WLS Promotion”).  The Slim Down To Stardom WLS Promotion will begin on December 1st, 2017 (9:00 AM EST) and will end on April 30th, 2018, (12:00 AM EST). Entries must be received by 12:00 AM EST via online entry.

(b)  To participate in the Slim Down To Stardom WLS Promotion, you may enter via the following method:  Online application found at www.humanicare.ca/free-weight-loss-surgery.  Applications must be completed in their entirety and submitted by the dates and times outlined above.

(c)  One official application per person will be accepted.  Please be sure that all information is filled out accurately and completely.  No entry forms or any items submitted with the entry forms, including but not limited to photographs or videos, will be returned.

(d)  You agree to be bound to these Rules by submitting an entry form to participate in the Slim Down To Stardom WLS Promotion.  Please read these Rules carefully to ensure that you understand and are prepared to keep the commitment that comes with participation and the obligations that the winner of the Promotion must fulfill.

2.  ELIGIBILITY RESTRICTIONS.

(a)  The Promotion is open to all persons who are 18 years of age or older and who reside in Canada or the United States of America.

(b)  Criteria to be an eligible candidate for the Slim Down To Stardom WLS Promotion are available at www.humanicare.ca/free-weight-loss-surgery with the online entry form.  Your submission of an entry form constitutes a representation that you have read, understood, and satisfy the eligibility criteria, subject to verification by Dr. José Castañeda and Humanicare Inc.  Any and all determinations of your medical eligibility, and any and all information provided by you to ascertain medical eligibility, shall be solely the responsibility of Dr. José Castañeda and Humanicare Inc.

3. PRIZE.

(a)  The winner of the Slim Down To Stardom WLS Promotion will be eligible to receive either gastric bypass surgery or vertical sleeve gastrectomy surgery from and performed by renowned bariatric surgeon Dr. José Antonio Castañeda at the Jardines Hospital de Especialidades in Jalisco, Guadalajara, Mexico.  The winner will have to present him or herself, as required by Dr. José Castañeda, to undergo the designated weight loss surgery within 60 days after the winner is selected and announced.

(b)  The winner of the Slim Down To Stardom WLS Promotion will receive:

          1.   the most appropriate weight loss surgery as determined by Dr. José Castañeda and his highly-skilled team of medical professionals;

          2.   any costs associated with complications, non-standard tests and procedures, hernia repair if necessary, pre- and post-operative testing and post-operative medication;

          3.   return airfare to Guadalajara, three nights stay at a hotel close to the hospital, ground transportation to and from airport and between hotel and hospital for appointment with Dr. José Castañeda; and

          4.   twelve months of one-on-one weekly lifestyle coaching and empowerment calls, success planning, accountability and progress tracking, nutritional meal planning, emotional support by Humanicare Inc.

(c)  The approximate value of the prize to be awarded is CDN $14,440.00.

(d)  The winner will forfeit the prize unless he or she: (1) responds within seven (7) days to the notification (or attempted notification) from Dr. José Castañeda and Humanicare Inc. that he or she has been selected as the winner, (2) satisfies all requirements of these Rules, including, but not limited to, the Conditions set forth in Section 5 below, and (3) follows the advice, recommendations, and instructions of Dr. José Castañeda and Humanicare Inc. pertaining in any way to the weight loss surgery.

(e)  There is no substitution, transfer, or cash equivalent for prizes, except that Dr. José Castañeda and Humanicare Inc. may, at their sole discretion, substitute prizes of comparable value. The prize is expressly limited to the item listed in section 3.(b) and does not include taxes, gratuities, or any other expenses. Other restrictions may apply.

4.  WINNER SELECTION AND NOTIFICATION.

(a)  Dr. José Castañeda and Humanicare Inc. shall have complete discretion with respect to any decision, application or interpretation of these Rules for the Slim Down To Stardom WLS Promotion and any decision or interpretation shall be final, conclusive, and binding upon participants in the Promotion.

(b)  After the previously stated deadlines for submission of official entries, Dr. José Castañeda and Humanicare Inc. will review the entries and choose five (5) candidates who appear to be medically eligible for and would benefit from the weight loss surgery.  Those five (5) candidates will have a video conference call with Dr. José Castañeda and Humanicare Inc. to confirm eligibility.  The prize winner will be chosen on or before May 31st, 2018.

(c)  The odds of winning the Slim Down To Stardom WLS Promotion depend on the number of entries received from eligible contestants.

(d)  Dr. José Castañeda and Humanicare Inc. will notify the winner by phone, email or by mail using the contact information provided by the winner on his or her entry form.

(e)  The winner will be required to successfully answer a time limited mathematical skill-testing question.

5. CONDITIONS.

(a)  The winner, as a condition of receiving and as consideration for the prize, must execute and deliver to Dr. José Castañeda and Humanicare Inc. a Release and Waiver of Liability by which the winner promises and agrees to hold Dr. José Castañeda and Humanicare Inc., their corporate licensees, parents, subsidiaries and affiliated companies, and each and all of their respective officers, shareholders, members, directors, employees, agents and representatives, harmless from and against any and all claims or liability arising directly or indirectly from the Slim Down To Stardom WLS Promotion.  The winner agrees to have his or her name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.  More specifically, and as a condition of receiving and as consideration for the prize, the winner promises and agrees for a period of twenty-four (24) months following the weight loss surgery:

1.  To attend monthly follow-up appointments with Humanicare Inc. with weigh in and photo documentation.

2.  To meet with a nutritionist every two months.

3.  To participate in on-air interviews with radio/TV stations as requested by Dr. José Castañeda and Humanicare Inc. throughout the course of 24 months.

4.  To write web blogs and to capture video testimonial no less than 3 times a month to be posted online at the discretion of Dr. José Castañeda and Humanicare Inc. for the purpose of candid discussion and publicizing the winner’s experience related to the weight loss surgery.

5.  Participate in Humanicare Inc. educational seminars as requested by Humanicare Inc. throughout the course of 24 months.

6.  Participate in promotional events as requested by Dr. José Castañeda and Humanicare Inc. throughout the course of 24 months.

7.  To participate in media training as requested by Dr. José Castañeda and Humanicare Inc. prior to any promotional activities.

8.  To participate in any PR activities as requested by Dr. José Castañeda and Humanicare Inc. throughout the course of 24 months, including national or local programs/outlets in all forms.

9.  To participate in up to three stand-alone photo shoots at a date, time and location to be mutually agreed upon.  Wardrobe to be approved by Dr. José Castañeda and Humanicare Inc.

(c)  Dr. José Castañeda and Humanicare Inc. reserve the right to make changes in the Slim Down To Stardom WLS Promotion.  If, due to circumstances beyond the control of Dr. José Castañeda and Humanicare Inc., the weight loss surgery is delayed, rescheduled, postponed, or cancelled, Dr. José Castañeda and Humanicare Inc. reserve the right, but not the obligation, to cancel or to modify the Slim Down To Stardom WLS Promotion and shall not be required to award a substitute prize.

(d)  Failure to comply with Slim Down To Stardom WLS Promotion Rules may, in the sole and absolute discretion of Dr. José Castañeda and Humanicare Inc., result in a contestant’s disqualification from the Contest and/or the forfeiture of the prize.
